Terms and Conditions for NexGen Transfers Shuttle Services (South Africa)

Welcome to NexGen Transfers Shuttle Services ("NexGen," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our shuttle services in South Africa, including bookings, payments, cancellations, and passenger conduct. By booking or using our services, you agree to comply with these Terms.
1. Booking and Reservations
1.1. All shuttle service bookings must be made through our official website, mobile app, or authorized third-party platforms.
1.2. Passengers must provide accurate information, including pickup/drop-off locations, contact details, and the number of passengers.
1.3. A confirmed booking is subject to availability. NexGen reserves the right to refuse service due to operational constraints or safety concerns.
2. Payments and Pricing
2.1. All prices are quoted in South African Rand (ZAR) and are subject to change without prior notice. The fare quoted at the time of booking is final unless additional services are requested.
2.2. Accepted payment methods include credit/debit cards, EFT, and cash (if pre-arranged).
2.3. Full payment is required at the time of booking unless otherwise specified.
3. Cancellations and Refunds
3.1. Cancellation by Passenger:
- Cancellations made 24 hours or more before the scheduled pickup are eligible for a full refund.
- Cancellations made less than 24 hours before pickup will incur a 50% cancellation fee.
- No-shows will result in a forfeiture of the full fare.
3.2. Cancellation by NexGen:
- If we cancel due to unforeseen circumstances (e.g., extreme weather, vehicle issues), passengers will receive a full refund or option to reschedule.
4. Passenger Responsibilities
4.1. Passengers must arrive at the designated pickup point at least 20 minutes before the scheduled time.
4.2. Luggage is limited to 1 standard suitcase (max 23kg) + 1 carry-on bag per passenger. Oversized or excessive luggage may incur additional fees.
4.3. Passengers must comply with South African road safety laws, including wearing seatbelts at all times.
5. Prohibited Conduct
5.1. Strictly prohibited in the shuttle:
- Smoking (including e-cigarettes)
- Consumption of alcohol or illegal substances
- Disruptive or abusive behavior
5.2. Violations may result in immediate termination of service without refund, and offenders may be reported to authorities if necessary.
6. Liability and Limitations
6.1. NexGen is not liable for delays caused by:
- Traffic congestion
- Road closures
- Extreme weather conditions
- Other unforeseen events beyond our control
6.2. We are not responsible for lost, stolen, or damaged personal belongings left in the shuttle.
6.3. Passengers will be held financially liable for any damages caused to the vehicle due to negligence or misconduct.
7. Privacy Policy (POPIA Compliance)
7.1. NexGen complies with the Protection of Personal Information Act (POPIA) of South Africa. Personal data collected will only be used for booking purposes and will not be shared unlawfully.
8. Changes to Terms
8.1. NexGen reserves the right to modify these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
9. Governing Law and Dispute Resolution
9.1. These Terms shall be governed by and construed in accordance with the laws of South Africa.
9.2. Any disputes shall first be resolved through negotiation. If unresolved, disputes may be submitted to the appropriate South African courts.
